I’m no attorney but a private business owner has the right to refuse service legally as long as not discriminatory right? And not sure having a low/high temperature is under any protected class.
I doubt that. At Bank of America, there was a security guard at the door only letting people come in that had a mask on.
Body temperature isn't a protected class in any state.
Restricting based on temperature is one thing, but capturing the data may be a separate thing. Would there be issues with capturing the info? I assumed it'd have to be clear how the company is disposing of that information. Which i assume would need to be immediately.
What if the temp scanner was legible from security cameras,then you are storing private health information?
(just some thoughts, not in legal or health industry)
