Or just work 40 hrs. The contract swings both ways.

If your contract doesn’t specify 40 hours specifically then you’re stuck. If it says 40, then I’d go back to the person who sent you the contract and let them know that the project requires more than 40 hours a week and you’d like to discuss additional compensation above and beyond what was agreed to. See what the response is.

Stop working once you hit 40 hours, and let them hire you again if they still need you.

Should add in your contract for OT hours you get time and a half or 2x your rate. Bean counting agencies will mange your time better once that first OT timesheet check clears

I've been on both sides of this, the freelancer and the hiring manager and the best advice I can give you is that clear communication is key. Are they even aware that you're working more than 40? If you aren't telling them or billing them for it, they're probably blissfully unaware. That, or they think you just don't mind putting in the OT (in this case, that's Own Time). At a minimum, let them know when you're closing in on the cap (say at 30 hours), ask them to prioritize the work they need you to get done with the remaining 10 hours this week. If they want/need/expect all of it to get done -- and that's not a reasonably expectation for the allotted time -- then bring up potential overtime charges (the best time to have the overtime conversation is when you're signing the contract. The 2nd best time is now. Same goes for rush fees). Do not just hit 40 hours and stop working - you'll miss deadlines and that's the fastest way to piss off a client and lose the gig. Do not send them an invoice with OT charges you didn't discuss first. Clients do not like to be surprised when it comes to billing, or in general, actually. But especially with billing. What state are you in? I think in NY and CA they would be required to pay you OT if it’s not a day rate or weekly gig. I think you would have leverage here to flag that you are working OT hours.

You can tell them you’re happy to cap your hours at the contracted rate, or to work OT for x amount Personally, these days I usually just prorate hourly for OT rather than charge extra. But most of my gigs are super light on OT, if I was getting asked to do weekends routinely I would ask for more to disincentivize that behavior

Are you sure the contract doesn't have an OT clause somewhere in it? Most contracts do.

What scope did you sign, and how do you bill? I agreed to a 40 hour week but bill weekly for my hours. If I go over 40 I bill that amount (straight time because of the state I'm in). If they want to adjust my workload to be under those hours they can, otherwise they pay.
