Any advice on how to manage court and covid. Here’s my reality- I practice in a state with mid-level spread, a prohibition on mask mandates (prohibited both statewide and for the courts), and hard to come by testing with huge result lags. I have a court heavy practice (I am in court daily, 3-6 hours a day). Our courts are not doing ANY screening, social distancing, extra cleaning etc. today, for example, I had an afternoon of trials with 20-30 people in a (continued in comments)
Agree with A1. Go to a more friendly nation that appreciates your talent. I went back to India when my H1B got denied and couldn’t be happier to be in a place that welcomes me

This country has ceased to make any sense. Go the EY UK/AUS route OP. And while you're there you can even consider applying for a Canadian PR; it is an easy path to citizenship as well if that interests you. With your qualifications any sane country would welcome you as an asset
I was filed under operations research analyst title and I have a PhD and MS in OR related majors :( yes, I did get RFE first and the lawyer didn’t share the materials they have prepared for RFE
Sorry to hear OP. A friend at McKinsey got his H1B denied and reason was that "you don't need a COLLEGE degree for this role". He was a post MBA associate🤦🏻♂️

I do think the attorney needs to take some responsibility. For my case, they should have put in another SOC code that matches better to my academic background and job duties.

They did not appeal. They filed for the extension again. Thankfully my I94 was still active when my H1 was rejected.

SA1 - why would you blame it on the attorneys? You know the denial rate across the US has increased by at least 40% in the last several months, right? Doesn’t sound like an attorney problem to me.
It is the attorney. They give you very specific reasons for the denial. Wrong SOC code, not enough evidence etc. Plus their obligation is towards the firm and will not go the extra mile for your case which is needed in this political climate
Denied cap cases cannot be refiled. You also cannot submit an appeal indicating a different SOC code.

How is consulting a non specialty occupation? I don't get it. Did you have an RFE issued in your case asking for further evidence that your role is indeed a specialty occupation?
What SOC code did they file you under? Also, did you get an RFE first, and how did you respond?
It's mainly to do with your undergraduate major and SOC code. Probably a discrepancy there or SOC code doesn't call for undergraduate degree
OP do you mind sharing your nationality? Do you think that played a factor?
