Yes, it’s exploiting a loophole. It’s ageism, but it’s legal for now. It should be illegal, as its violating the EOE laws in spirit.
Recruiter *weasel phrases* that dangerously flirt with being illegal
• “5–7 years experience”
• “no CDs”
• “juniors only”
Instead of those phrases, the post should instead simply state the level of the role.
I don’t care if the job is an entry-level role making banners, if an ECD knowingly applies for that junior banner job, it is ILLEGAL to deny that person the chance to have an opportunity for that job, especially when they are really good at it.
I have applied for “lower“ jobs and it’s never gone anywhere even though I say I am more than willing to be flexible on salary and title, I just love doing the work and mentoring etc. A lot of places fear that you will just be disgruntled or “disrespected“ in a smaller position. Also, most recruiters are morons. So there’s that.
It’s not really turning up their noses, it’s that they know candidates who’ve already progressed past that role will be dissatisfied and leave sooner, even if the candidate has said they’re fine with it. It’s pretty common ¯\_(ツ)_/¯

Actually it’s not for me. I was trying to refer a friend. However, it’s a common “out” for hiring managers that I have always wondered about.
It’s fine to say what years of experience you want because that is what that position is budgeted for, but they shouldn’t be surprised or act indignant when people with more experience apply, thinking that that is just the minimum number of years required.
That's what the role's title does, and that's what stating the pay rate does. Someone older with more experience might be perfectly fine doing a lower-level job. Capping the number of years of experience is flirting with being illegal.
