Definitely the latter. Current employer won’t let you do it, but new offer lets you file patents and demonstrates stronger tie to your product

Check your state’s laws — some states don’t allow companies to ban moonlighting, or make these kinds of clauses unenforceable.
Conflict of Interest Outside employment is prohibited unless approved by the employer in advance. The company will deny permission for such outside employment if at any point it adversely affects the employee's ability, fitness, or readiness to work.
