I’ve definitely formed the view over my career that the adversarial system is far from optimal in resolving disputes, and probably has imposed enormous societal costs as well.
Honestly the adversarial nature is grating at times. Makes me wonder if I should retool to corporate. But then I lose the somewhat predictability of litigation… is there a practice where I can have it all 😂
FYI bk attorneys have a reputation among litigation attorneys as not being adversarial enough, so I don't agree with the previous opinion. I am also of the opinion that restructuring isn't adversarial enough for me even though it's what I wanted to do while in law school, so take my opinion for what it's worth.
I’m only a second year but decided recently that I just couldn’t do litigation and moved into corporate (helped that my firm’s corporate/commercial department is desperate for associates). Not that there isn’t conflict in corporate, but everything being super adversarial all the time and over the smallest things really started to grate, I get you!!
I’m a rising fourth year trying to transition to transactional for this very reason. Would love if anyone reading this could share their experience if they’ve made this transition.
