Too many tasks; focus on settling cases rather than working them up; I left a good job w/mentoring selling out for more pay, now I feel like I’m not learning anything. Torn abt going back. Thoughts?

I think you just have to get used to this. Settling more cases is becoming the new normal. There’s a pervasive underlying hatred for corporations or anyone with money, and we are moving further and further away from personal accountability every year. That argument just doesn’t resonate. Plaintiffs lawyers have tapped into this and are in full attack mode, making more money than ever and hitting comically enormous verdicts all over the nation. Corporations and carriers are not only afraid to get hit, but they also don’t want to spend money to defend cases the right way. It’s become a straight numbers game, and trying cases is becoming a lost art for the defense. I know very view defense lawyers in their 30s-40s turning into trial lawyers. Meanwhile, the plaintiffs bar is churning out armies of trial lawyers who get more blood on their teeth every year. The defense used to have the advantage. Not anymore. It’s a new day and a new public mentality. Just about every client is letting it happen and just chalks it up to cost of doing business. Firms have no choice but to follow the leader.

Did you switch to defense work? I had a similar thing happen to me when I switched defense firms. My day went from (a) learning and growing to (b) spending most days drafting reports to clients (they were 85 percent forms and very similar case to case) and trying to settle cases.

Started to feel like a robot and had a very low job satisfaction.

At what point do you begin to feel numb (if ever) when you’re done trial and prepping for another trial in a span of 3 months, while mains full caseload of other active litigation cases? Should I be worried that I’m going from engaged and stress to numb and slightly indifferent? Or is this what it feels like to power through? I can’t gauge it anymore? And can’t impose judgment one way or another either.

What’s your go to process/steps for drafting an MSJ on a case you’re already familiar with?

Deadline to Answer was missed, judicial default was entered, then a Default Final Judgment was entered without a hearing. Would this be an additional grounds for a Motion to Set Aside/Vacate? Assistant forgot to the calendar deadline, and when judicial default was issued, assistant was assigned to file the Answer/Counterclaim, but did not. Soon after, she quit. Was first put on notice when DFJ was issued.
