Um…he’s the one that left his mic on! I wouldn’t be too worried about his opinion. And a depo that doesn’t feel great in the moment can turn out beautifully on paper. Eyes on the prize. I bet you hit all points you needed to hit and the transcript turns out way better than you thought.

Hopefully when you confronted him it was on the record. When I took my first deposition, a friend warned me what tactics an older (male) attorney would use to throw me off my game. Literally everything she warned me about played out exactly as she said. I am grateful she gave me the heads up and how to handle it; however, neither of us were prepared when opposing counsel physically took my exhibits and wouldn’t give them back! Later at a mediation the opposing counsel praised me to the partner on how I handled the deposition. Such a tool.

Regardless how you were doing, he may have an incentive or motivation to tell his clients you suck to boost their confidence and help his standing with them. He’s not going to tell them that they’re getting their butt kicked! I definitely wouldn’t worry about it.

The downside of an adversarial system is that you win some AND lose some. Keep your eyes on the prize and come back strong. This is a marathon not a sprint, and those who lose battles (all of us) can go on to win the war. Hang in there and slay it in the next round!

A lot of litigators enjoy the “game” aspect of litigation. They’re usually tools and enormous time wasters (which corresponds conveniently with bill-padding). Don’t get rattled. Just laugh at their ridiculousness and move on.
