An example would be: H1b expires March 2018, extension filed Jan 2018. In October 2018 you get denied. The original polcy was you will be out of status from the denial date and have couple of weeks to leave. The guidance which came last month started the you will be out of status when your original H1b expired. Since it's already October you have over stayed by six months and will be subject to removal proceedings. The problem with the NTA if that you cannot leave and must appear in immigration court. The latest guidance temporary puts a push on this.

It appears the original guidance for back dating your out of status will not be implemented starting next month
