We are a same-sex couple pursuing surrogacy. My spouse works for a Fortune 5 company. This company says it stands for equity and inclusion and it offers as an employee benefit coverage for fertility-related medical expenditures. Specifically, this employer’s fertility benefits provide up to $25,000 for fertility expenditures to heterosexual couples, and $0 to same-sex couples. How do we contest this inequitable employer policy?

Talk to your ERG and HR.

Have you reached out to benefits team? I would talk to your benefits team or HR to ask if this policy applies to same-sex couples as it is for heterosexual couples first. Did they say this doesn’t apply to same-sex couples?

Thanks, hopefully this ends up with one more open door for LGBT employees at this company- myself included.

I’d just like to add that RBG would say that “On the Basis of Sex” this distinction is bunk. Not sure how far that traction will get you, but just want to say I’m sorry you have to deal with this and a great woman would support your endeavors.

My firm offers $40k for all parental planning regardless of sex, so there are places that don’t just follow the insurance guidelines.

That’s a good benefit- inclusive, equitable, any employee with a goal to grow their family can take advantage of that benefit the same way. UnitedHealth - where are you?

I'm 6 months out of undergrad at a mid sized firm and am a very career oriented person.
