We have a firm incorporated in one state and intend to open an office in another. Do firms typically create a new entity for this purpose, or do they just register as a foreign business?

It depends on the laws of the "new" state. IFor example, if you practice through a LLC and the new state doesn't permit LLC practice of law, you may have to form a PC or similar. If LLC practice is permitted, register as a foreign business.

I have been dating my GF for 3 years. I feel like I am not appreciated in the slightest bit - I get no “thank you”, I get no acknowledgement of anything I do for us. I’m not asking for her to bow down on like taking the trash out - but I mean some recognition every now and then would mean a lot to me. How do I bring this up?

Crowdsourcing perspective. Had an advisor help me negotiate my new job offer behind the scenes. They were not compensated at all but we have a good working relationship (we have helped each other over decade+). What would be a nice gift to acknowledge/appreciate the help? It was a half dozen conversations over two months so not immaterial commitment of time.

When an equity partner retires, how do your firms structure the buy-out of the retiring partner’s interest? Is it a substantive buyout or a nominal amount? If nominal, doesn’t this just incentivize the lawyer to keep working until she’s 100 years old and dies at her desk?

We are a very small firm. I have had a paralegal working for me for 14 years. She is my longest tenured employee. She is good but by no means a superstar. I have given her a raise and bonus annually. I am trying to figure out at what point I might stop giving her raises. On the one hand, she is a valuable employee. On the other hand, I could probably get someone cheaper who could do the job as well and giving a raise every year because she expects one may be too generous. I appreciate input.

How does your firm calculate your pay each year? Is there clear quantification of successful marketing/client development efforts, time towards client billing responsibilities, time towards leadership responsibilities, your billed and collected time, and work you delegate to others? If so, how is it broken down? Is it quantified throughout the year to tabulate how you’re doing, so you can forecast a likely year-end amount for yourself? In other words, how is your number baked up each year?

I’m interviewing for secretary and came across one I like who has 12 years experience at a well-respected law firm on Long Island. She has worked primarily in litigation. Two things seem wonky though: I asked her if she is a notary public and she said “no” and when I asked how what her salary requirement is and she only asked for $65k per annum. Am I missing something here?

Any suggestions on how to make a partner who has traditionally been required to spend 30% of their time marketing and 70% billing accountable for their time and efforts spent marketing. I feel during Covid this is becoming increasingly more challenging.

I have a small firm and am contemplating acquiring a practice from a retiring attorney. The plan would be to bring him into the firm for a year or two first to transition the clients. Is there a standard payment structure once he retires? Such as percent collected each month from his client base? Agreed upon salary for a set amount of time? Any suggestions or insight would be appreciated.

D&I clearly is the morally right thing to do. Will lack of opportunity and other headwinds for non-diverse talent force talent to leave and form boutiques to compete on skill. Will put tremendous pressure on the business model of latecomers to the world of D&I. I fear carnage ahead for mediocrity.
