I understand their position from a legal perspective; you have to aggressively prevent others from using your IP, otherwise, you risk losing it (at least for trademarks). But I think there are examples of Nintendo overreaching. For example, their early approach to live streaming and YouTube video monetization shows a short-sighted, limited understanding of the massive brand value of a healthy live streaming environment. Similarly, their lack of support for esports, fighting game tournaments, and regional Mario kart go-karting shops, highlights an inflexibility that damages their reputation.
I think it's mostly a Japanese business strategy mindset. The oldest, highest ranking executives are firmly set in their particular style and do not approve of certain changes. We've seen similar positions taken by Japanese companies like Square where they demonstrate a strange lack of understanding when it comes to the US market, current culture and evolution of games, and the way that their decisions are perceived.
Another great example is the convoluted way that Nintendo creates online experiences. They have an entirely separate app for voice chat and an antiquated friend code system because they fundamentally don't seem to understand why people want these things or how to provide them well while still protecting young gamers.
