Does anyone have recommendations for classes or trainings that helped you gain greater expertise in reviewing and negotiating commercial contracts, particularly sophisticated SaaS agreements? California attorneys — I am having difficulty finding authority concerning the use of a rejected (partial) settlement offer to claim that a party failed to mitigate their damages. I.E. plaintiff could have mitigated if they accepted the (partial) settlement offer. Defendant offered to settle one claim (without affecting the others). Plaintiff rejected. The value of damages has increased over time and now defendant claims that plaintiff failed to mitigate because they did not accept the offer. TY

When your firm requires billable hours, how are they calculated? Actual vs realized (I.e. what you put on your billing sheet vs what is billed to the client). Does your firm differentiate? Which number do they go by? My mind is somehow not comprehending how some big law hours are under my small firm requirement?
