Does your employee handbook have anything that talks about this?
Ours is 6 months.
At our old firm we had a lot of boomerangs and we honored their previous time served. We had to enter a created seniority date to calculate benefits.
While we honor [broken] length of service with respect to certain retirement benefits, all else including PTO “resets” on your most recent hire date. It’s easy to document and consistent across the board for everyone so people are treated the same. By implementing too many rules and exceptions you will make it harder on the team to track and manage long-term, not to mention it could land you in hot water for disparate impact in specific scenarios. Recommendation from me is to “draw the line” on Day 1.
Our system has a leave accrual date that it uses to do the calculation. It cannot handle breaks of service so we end up going off the original hire date which can cause some inequities when there are large gaps.
Prior to going unlimited, we just kept previously earned accruals in place - regardless of the gap in employment dates.
