Many defendants in discrimination cases do not have insurance. When I was on the defense side at a large law firm, I found that the best lawyering in these instances is to explain the value in early settlement to the client.

One other thought—if you lay out the options to your client and get authority to do so, I would call the plaintiff’s counsel and explain the situation. No plaintiff’s counsel wants to deal with a bankruptcy. A reasonable plaintiff’s counsel will appreciate the candor and be in position to explain to his client why maybe taking a $10k settlement is not so bad under the circumstances. It may not work, but it is worth the call.

You should get them in touch with a bankruptcy attorney as you need to file before the suit concludes from what I remember.
