Whats the deal with some people being fine filling out I9s virtually and some emphasizing the need to see identification in person? I understand the current law is that if your company is fully remote, you can verify virtually.

Ignoring the additional COVID rules:
The law is that an ID always needs to be viewed in person by someone, but that someone doesn't have to work for the company. It simply has to be someone 18 years or older that the hire can meet with in person who is willing to look at their ID and fill out Section 2, and this needs to happen on US soil. While there's no way to prove the section 2 person reviewed the ID, it's considered perjury against them if they didn't and they get found out by USCIS. When they sign, that is the agreement.

Note, I-9s have to follow a number of other rules to be done digitally. For example, they can't just be signed in basic Adobe. There has to be audit trails and other things that usually are best found in an official I-9 system.

The reason you see many companies do it wrong is because there's many rules about the form, and the government makes it intentionally difficult. When an I-9 is incorrect in an audit, the government gets $$$.

I think it's more of a consensus than a law. Attitudes can vary from company to company.

It is actually a law unfortunately. Companies can get fined a whole lot of money if they don't follow it properly - and many do not. As the government intends.

We outsource our payroll function. But as the head of HR in a rapidly-growing business but still young, I'm still managing a portion of the administrative burdens related to payroll, PTO, insurance, etc. Recruiting, full onboarding duties, and company policies are among SOME other tasks I own. Beyond this, everytime the word "compliance" arises, immediately, it's put on my plate. My company stretches the word "onboarding" to when we bring on subcontractors, it is again an "HR thing."
