What's your go-to line for politely referring an old or existing challenging client out for new work when you don't want to represent them yourself?

I tell them I’m overcommitted and then give them the cell number and private email of a competent lawyer who I hate, who is too stupid to realize that every single client I send him is a pain in the ass. Perfect outcome for all concerned.

Always have to shoot for the win win solution. 😈

So, this may not be the scenario you’re asking about, but nevertheless, if you’re dealing with a corporate client, I have twice had lawyers tell me that my organization (not me of course) is a pain in the ass and they don’t want to work with us anymore. It’s an amazing managing up tool to be able to go back to your pain-in-the-ass boss and say, “remember that bullshit you pulled with the fees and the changing your mind and the micromanaging of outside counsel you pulled? Yeah, they won’t represent us again ever. So, when I told you not to do that, I was right. You’re a cancer and need to change your carcinogenic ways.” Having an inherently respectable third party validate claims of abusive or otherwise problematic behavior can be an amazing benefit.

I love this response.

I usually just quadruple my fee from the previous matter. It has been effective thus far.

What is dead may never die.

If the new work is adversarial to another party I cite to a business conflict. Simple example, “bob, I would love to take this medmal case, but the firm is expanding its medmal defense practice. This is a super territorial area and I’m not sure I can bring on a plaintiff’s med mal case without seriously disrupting the group and causing some internal issues and possibly some business issues with our defense client base. You should talk to *** she is who I would trust with my own med mal case”

like

“It’s gonna be a no from me dawg” but seriously, overcommitted at this time.

6 months in at a new firm. 4th year attorney. Completely new practice area from what I did previously. The partner often sends the random potential client call ins my way. Many times, they have questions related to things I’ve never done and he only provides guidance if I can pull him away from something else to ask. I’m super low on hours but feel that it would be ethically wrong to take on a case involving an issue Im totally unfamiliar with and not confident handling. Wrong approach?
