When citing to documents filed on ECF in a brief, do you cite to the ECF-stamped page numbers or the page numbers created by the party in Word?

I would cite to the ECF pages. I usually use “R##:##”. The first number is the document number. The second is the page in the document. The first time I cite to the document, I may put a parenthetical afterwards to describe the document if that is not apparent from the context.

Pretty sure blue book rules say do the ECF page numbers UNLESS they conflict with the PDF’s page number, then you use the PDF’s page no.

The document page number. When you use Supra or Infra, you use the document page numbers not ECF. Why would you use a completely different numbering system when citing someone else’s document?

Here is my dilemma: I am filing a reply brief in support of a motion and need to reply to two opposition briefs. One party used Word page numbering, the other did not. I would normally cite to Word page numbers, but think I need to do ECF numbering for both because that is the only way to be consistent. In any case, should I just drop a FN to say which I am using?

Perhaps. I think the advisability of an omnibus reply depends upon whether there is significant overlap between the issues covered in the briefs in opposition and whether the local rules have a word/page limit for reply briefs (many courts don’t).

I use the party’s page numbering if it’s a brief. “Plaintiff’s Br. at x.”

Always the PageId No. you will make the law clerk/staff attorneys’ life easier.
