Will an OVI/DUI from 10 years ago cause a big firm to rescind an offer to a lateral candidate? Also, what else is looked at during the background check?

Almost surely not, unless you lied about it like A1 said. They’ll also probably check your credit.

No. I had one about a year before I lateraled (it was ultimately dismissed through pretrial adjudication). While the in-house recruiter asked about it and had to take an extra day or so to get it cleared by a higher up, I still got an offer. It was a nerve wracking 24 hours or so, though!

How does hourly contract lawyering work? I’m on a contract through a recruiting firm before the company hires me directly. My pay is hourly but I get time and a half for over time. I’m currently a policy atty for a think tank and did prosecution before that so I’ve never “billed.” I regularly check and respond to emails on my phone in the evening after work. Do I include that on my timesheet??

The amount of people, even attorneys, who can't separate out the policy merits of abortion from the issue of whether it is a constitutional right is disappointing. I consider myself pro-choice ---I believe states should allow it, that the federal government can pass a statute to guarantee it, and that FDA statutes and regulations will preempt any state trying to ban chemical abortions through FDA approved drugs. Dobbs at its core is a case about the Due Process Clause, not the policy of abortion

My firm has a collections budget (80% of your billable rate x 1850 hours) and an hourly budget that must be met in order to be eligible for a bonus. The firm cares very little about originations and will reward someone for making their collections over someone who brings in new work. I missed my collection budget due to some odd timing with a client, but originated more than all my peers so no bonus for me. I’ve been at this same mid level firm for 9 years and it’s all I know. Is this normal??

Plaintiffs counsel took my clients deposition today. He mentioned that he would likely be ordering the transcripts and I suggested we split the cost of them (in front of court reporter). He got pretty defensive and said absolutely not, it’s unfair to the court reporter, and that it is frowned upon in the industry to do that. Each party orders (and pays for) their own copy. I’m in my 2nd year of practice, never heard such a thing. I’ve actually split the cost before! Curious for insight on this…
