My company is laying off a lot of merit employees. Can they hold me accountable to a “no compete ” if I leave on my own?
1 depends on the state you live in. California, North Dakota, Montana, and Oklahoma will not enforce.
2 They would have to exercise it in court. This isn't a problem as you can prove it may cause "undue harm" by the non-compete. Example Im a welder for 20 yrs. Don't expect me not to weld to make a living. Or you have worked in an industry for years, you cannot just throw that knowledge away.
3 most critical. If you have detailed knowledge of their operations, processes, and systems. Expect them to exercise it and it to hold up, unless in a protected state. It will likely only hold for 1 year, unless the company can argue for longer.
Worst case do something else for 1 year and jump back in the industry.
