Yes. I had preterm labor from stress—would not recommend.
A former boss did her closing statement while in active labor, so it is possible. Did she recommend it? No.
I tried cases in my first and second trimester, and while nursing. But not during my third trimester.
I would not do that. I was exhausted during my third trimester. I couldn’t speak for long periods of time without losing too much oxygen.
I think it all depends on the case and how much help you have. I tried a case at 35 weeks that lasted 8 days (personal injury), but I had an amazing partner/mentor who second chaired with me. I did most of the work because this case was my baby but having someone I knew I could rely on to pitch in really reduced my stress. But ultimately if you think it is too much for you (mind or body) then you should trust that feeling and see if opposing counsel would agree to a continuance or see if a colleague could take over as lead and you take more of a support role.
