It can be a good idea to sue if you have a case that's actionable and you have the proof that a lawyer would need to take your case. But you can't sue because you think a workplace is toxic, there would have to be some legal infractions. So far as whether it can affect future employment, sure, it could. An organization may not want to hire someone who has sued an employer. They may not say that outright, but they can always find a reason to pass on you and choose someone else.
No one can really afford to sue anyone so there's nothing you can do about. It is disturbing how bad employees get treated and they are supposed to put up with it for a pay cheque. Then if they can't deal with it anymore and decide to leave that makes them a horrible person? Wtf actually
Yes, if you have documented proof, witnesses to the incidents, etc. you should speak to an attorney and they can determine if you have a case. Secondly, that information is strictly confidential and placed in locked files for only certain HR staff to access, same as Worker's Comp cases where the employee sued. A new employer has no way of finding that out unless you tell them, so don't! Also you can choose colleagues as a reference, or a manager in a different department that knows you and the work you did, but you didn't report to them, it doesn't have to be your direct supervisor or manager. The only questions a possible new employer can ask are: dates of hire, last day worked, position, rate of pay. They can no longer ask things about your performance reviews or even ask if you are eligible for rehire due to former employees suing because the past employer checked off they were not rehirable, and the person didn't get the job and sued. Keep in mind this can vary state to state. I completed thousands of employment verifications and even though the questions were on the form, I was only permitted to answer what I stated earlier above.

This is very helpful. Thanks for sharing your perspective. There are a lot of good points here. I really appreciate your thoroughness.
Depends... What are you gaining from this? I wouldn't do it if it's not really helping me in any way. Sometimes, we spend our energy on things that will only give us a hard time, so think about it and check what you will get from it? If it makes sense, then you should be good if things go your way.

You can get short term cash from a lawsuit but potentially not be able to find another job due to poor references.
