Plaintiff attorneys- thoughts on sending a copy of a settlement negotiation letter to the adjuster to their insured? This is pre-suit. Adjuster is being unreasonable with settlement talks and want to highlight this to their insured.

A few weeks ago I sent my resume in for a PCA posting. I’m qualified for the position yet never heard anything back. Not even a confirmation that my application was received. Is there anyway to reach out about it or should I just forget it and move on?

HR is not ready to share the exact budget they have (weird!! because HR usually give the idea of how much they can offer )

A director in another unit wants to meet me to “continue a conversation we started last year”. He is referring to the time I had asked him if there were openings on his team. That was over a year ago. I am not too happy where I am right now ( I stayed where I was). I also don’t know if he really has an opportunity or if this is just some corporate circle jerk where my current director is trying to “smoke me out”. I don’t speak poorly of my team/work. How do you deal with a Midlevel who tells the partner you’ll cover for them, but gives you less than 24 hours notice they’ll be gone without asking if you can cover? Plaintiffs PI attorneys, how many cases on average are you assigned to at any given time?

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

What do you guys send as gifts to referral sources for attorneys and/or former client referral sources?

Hello all, I'm a very green attorney, never tried a single case or even was second or third chair, but managed to land a litigation associate position at a Plaintiff's firm. Does anyone remember their first trial? How did you feel and how did it turn out by comparison? Anything you wish you did differently?
I know in THEORY what the process of trials are but thanks to COVID I haven't been able to observe them in real life so I'm very nervous for the day I finally enter a courtroom.

What kind of split does your firm give you for bringing in cases? Trying to negotiate with my firm for an increase. Currently, I get 15% plus my base salary.

I give my cell phone to all clients routinely. However, there are always 1 to 2 clients who abuse this and it seems as soon as their cases are over I find a new one and it is making me rethink. I hate to do this because 98% do not abuse it and I like being connected to my people. Thoughts??

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

I'm a 6th year attorney in NYC. Strictly defense work; started out with the City Law Dept, did a year and a half of med mal/construction, and for past year and a half have been at a well known defense firm working on high exposure construction accident cases. Contemplating taking a couple interviews at plaintiff's firms to see if there is a good fit. Does anyone have any advice on how approach discussions about compensation and what a market level comp package would or should look like?

I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

What are good KPIs for personal injury support staff?

I’m a 3L applying in NYC for post grad employment. Which plaintiffs PI/Med firms have the best opportunities for a junior? Everything I find, including my past summer job, is a small shop with 3 partners max and a handful of established associates. I would really like plaintiffs side.

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. I’m just starting to do PI on the side by myself at my firm, so this is probably a very dumb and obvious question.

As a former Corporate Counsel, now mostly solo practitioner in Federal Court specialty practice is a mixture of Bankruptcy, Immigration, Business Transactions and Employment law.
My question is could I affiliate "of counsel" on part of my practice like say only Employment Law?

How much support staff is reasonable to expect? Plaintiff PI, med mal/aviation and we’ve lost 2/4 “paralegals” in the last month. Lack of support staff really beginning to feel like it will limit my ability to handle the usual caseload. Was on an island before, and only going to get worse…

4th year at a mid size PI firm. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting. I respect the solo a lot, he’s a mentor, but I’ve got kids and I gotta get paid. Trying not to burn bridges, but I can’t wait years to get cut in. Advice?
