I've done it with a a cover letter explaining that they need independent counsel because their insurance company is deliberately putting them at risk of being sued and having excess exposure because the carrier won't fairly evaluate the claim. It isn't a magic bullet but it helps get the insured to raise hell.

I’ve done it a few times just to put some pressure on the adjuster, but it’s not something that works 100% of the time. If the adjuster is being unreasonable, i just file suit and start negotiating with defense counsel or litigation adjuster.

I do it a lot. People need to understand that the only reason they’re getting sued is because insurance companies are being greedy and not protecting them.

In my experience, a lot of times the adjuster doesn’t tell the insured that a demand has been sent out prelit. I’ve had a ton of defendants testify during their depositions that they didn’t know about any demands that were sent out until I put it in front of them in the depo.

How do you deal with a Midlevel who tells the partner you’ll cover for them, but gives you less than 24 hours notice they’ll be gone without asking if you can cover? Plaintiffs PI attorneys, how many cases on average are you assigned to at any given time?

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

Hello all, I'm a very green attorney, never tried a single case or even was second or third chair, but managed to land a litigation associate position at a Plaintiff's firm. Does anyone remember their first trial? How did you feel and how did it turn out by comparison? Anything you wish you did differently?
I know in THEORY what the process of trials are but thanks to COVID I haven't been able to observe them in real life so I'm very nervous for the day I finally enter a courtroom.

I give my cell phone to all clients routinely. However, there are always 1 to 2 clients who abuse this and it seems as soon as their cases are over I find a new one and it is making me rethink. I hate to do this because 98% do not abuse it and I like being connected to my people. Thoughts??

I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. I’m just starting to do PI on the side by myself at my firm, so this is probably a very dumb and obvious question.
