Why is it that attorneys always feel the need to file a TRO/preliminary injunction at or slightly before 5:00pm on a Friday, especially when they could have filed earlier. Do people really think that this type of gamesmanship does them any favors with the court?

Certainly not with the court, but possibly for their client.

Unfortunately the realities of private practice lead to that kind of results. You have 10 other cases and this TRO has to be filed this week. So you shoot for Tuesday or Wednesday but then someone drops a file on fire on your desk on Monday and you tell yourself that filing by Thursday will be fine. Of course the client who needs to sign the affidavit is in a meeting all day Wednesday and you can’t get him to look at the thing until Thursday. Ok, so now you’re shooting for Thursday afternoon but he ends up giving you feedback that require you to change some of your arguments. And then your partner or whomever gets pulled on another job covering a depo so you get sidetracked into another “quick” job and now you’re hoping to get this thing filed on Friday morning. So you show up bright and early on Friday but for some reason your computer is down/corrupt file/[insert whatever event outside of your control] and you lose 2 hours. By 5:00 Friday you’re lucky to get thins thing filed and you go pass out/get drunk and curse yourself ...

Ive been practicing in TX for 2-3 years at a big law firm doing mostly bankruptcy work (and some trial) and looking to clerk at a bankruptcy court in SDNY/DDE/EDVA (I am well aware of how great the SDTX judges are but I am set on leaving Texas). Anyone familiar with how many apps these judges normally get or what makes candidates stand out? Are these judges generally not interested in someone who has practiced in a different market?

I went to a T14 law school, got great grades and glowing recommendations, and wrote (what I thought was) a great writing sample. But I got rejected from all 70 federal clerkships I applied to. The only thing I can think of is: I took a non traditional route after law school and did a 2 year public interest fellowship in a niche field of administrative law. The rejection gave me a lot of self hatred. I still really want to clerk. Any advice? What is wrong with me? I feel like a failure.

Our chambers has been keeping up with assignments, incoming emails needing judge’s eyes, and written orders, all through Microsoft Planner. We share PDFs through Sharepoint folders. Although we still email draft orders back and forth, the system seems to work well enough. We still aren’t operating at our previous capacity because it takes 10x the number of steps to get a motion heard or an order entered—90% of our workload.
