Anyone have a sample contract clause for a procurement situation where you want the vendor to take responsibility for acquiring third-party software licenses and pass the license rights through to your client as part of the end deliverable?

Is it a viable business opportunity for a mid level patent litigation associate to leave BigLaw and consult? Service could include pre-litigation diligence (e.g., pre-litigation infringement analysis) for funding companies and law firms, overflow work, consulting for patent prosecution firms that take on ipr or litigation work, litigation consulting for tech companies that don’t have in-house counsel. Cross posting this in the BigLaw bowl.

Although I know you don’t need to pass the patent bar to “technically” do patent litigation, would it be a dead end move to pursue patent litigation without a technical degree / admission to the patent bar? In other words, would most BL firms refuse to staff associates on patent litigation cases if they don’t have a technical degree?
