Can an injured motorist sue an insurance company for not filing form FR-44, which requires BI limits of at least 100k, that insures a drunk driver with DUI convictions?

Put another way, can the injured motorist, who is seeking damages that exceed the 10k limit, go after the insurance company for failing to require that the drunk driver had the minimum policy limit required under FR-44?
