Defense attorneys any tips with dealing with terrible Adjustors and Adjustor’s who are not being honest with you.

What aren’t they being honest about?

By dishonest if you mean not being truthful about how much authority they have and/or what the reserves it generally just takes time. Once the adjuster trusts you and knows you won’t blow all of their authority on the first offer they generally will trust you with this information.

Are there really attorneys that
give up all their authority at once? For me it’s always “yeah they only gave me authorization for twenty dollars … I know I know absolutely ridiculous … I might be able to get fifty?”

There are some adjusters who withhold factual information about the case or will withhold prior discussions with Plaintiff’s Counsel. There are also Adjusters who will deny you told them about attorney fee exposure or punitive damage claims because they were being lazy or were afraid to tell their boss about it.

I’ve had adjusters down play a case simply because they didn’t want to talk to their boss about it when mediation coming up.

Document, document, document.

What’s a good LA or NY business litigation firm and salary to expect? I’m a 2yr with quite frankly a lot of experience across civ rights, PI, excessive force, wrongful death, employment defense, K dispute, corp. structure dispute, professional licensure. Write every kind of brief, appeals, argue motions, take depos. Am the only associate working directly under partner on all cases. In house or M&A/Real Estate Transactional are likely the end goal but want to get the litigation out of me first.

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)
