I work in a firm that is known for litigation defense. I’ve been developing my own plaintiffs practice as well. I am able to pay the bills with my hourly defense work, which gives me time to focus on a handful of high value PI case a year on contingency. I was recently negotiating a case and was told part of the reason the claims rep/OC was jerking me around was because they didn’t see me as a plaintiffs attorney. Is there any way to change this perception or does it just come over time?

This may be a broad question, but what would you describe as 1st year associate work? 2nd year? 3rd? And partner work?
Also would like to know size of firm in responses.

How many years did it take you to feel like you could handle a trial by yourself and feel comfortable? How many trials did you observe before getting to that point?

Sometimes dealing with judges in Cook County feels like being back in school and dealing with bullies. I’ve grown a tough skin and a mouth that respectfully calls it out (when possible). I know it’s part of the deal. But, I’m so tired of it!

Starting to feel I don’t like litigation. Third year. I’m not excited about winning an argument or destroying the other party’s arguments. But the current market doesn’t seem to favor a transition.

FL peoples: I signed a lease for a new place to start May 1 as my current landlord sold the unit I'm in. Turns out, the buyer wants to keep renting the unit and asked if I want to stay. Of course I want to stay. My new lease hasn't started so I'm pretty sure I can easily back out. For the new lease, I'm still pending full approval from a condo association as I have to do an in person interview. I have paid first months rent in advance. Is there anyway to get that money back?

Why do people distinguish between DOCUMENTS and COMMUNICATIONS in requests for documents. Aren’t communications a subset of documents? Is this a copy-paste holdover from interrogatories, or is there a valid reason to distinguish?

I am a first year associate and was asked to come up with 3-5 goals for the upcoming year. I have no idea how to set goals, however, given my work stream seems to be at the whims of our assignment coordinator. At what point do you begin to feel numb (if ever) when you’re done trial and prepping for another trial in a span of 3 months, while mains full caseload of other active litigation cases? Should I be worried that I’m going from engaged and stress to numb and slightly indifferent? Or is this what it feels like to power through? I can’t gauge it anymore? And can’t impose judgment one way or another either.

I feel like this is the busiest billable December I’ve had. Anyone else absolutely swamped with work this month?

Any tips on how to bring in clients to the firm? I do L&E and one of the things my firm goes over during annual evals is whether we bring in business, even for third year associates.

What is your understanding of the norms around whose names end up on a brief/complaint/motion papers etc.? I’m a midlevel at an AmLaw 20 firm and have twice been the principal drafter of something only to be cut from the signature block. The associate senior to me is on it despite having done far less of the work. And it’s not because it required a rewrite or something. The filed product is 80-90% my work. Am I wrong to be pissed off about this?

I just learned that I get to argue all of our pre-trial motions and do a direct examination at an upcoming trial. What are your best tips for preparing and setting yourself up for success? Trying to get ahead of my caseload feels like trying to climb a hill made of loosely-packed pebbles. No matter how much I scrabble, I’m sliding closer and closer to the bottom.

How do you get caught up (or even ahead) when you’re always behind? Assume that all things that can be offloaded have been offloaded. I cannot take one more all nighter trying to get a motion drafted two days before the deadline because I couldn’t get to it earlier.

Anyone here have any insight on lateraling to Rawle & Henderson? 10 years exp.
