LOUISIANA-specific:
If I attend my client’s deposition along with a legal assistant/law graduate (bar admission pending), are they permitted to participate (object, redirect) under my supervision or would that be unauthorized practice of law for them?

Been trying to suss this out for WEEKS.

Most definitely not… just as a paralegal couldn’t. I wouldn’t even risk it. No professional rule of conduct would allow that, and your law license would be on the line for even allowing it

like

I’ve practiced in Louisiana for 10 years. That’s absolutely unauthorized practice of law. They can attend with you and watch, and that’s it.

like

I’m not admitted in LA, but my answer is definitely not… that sounds very unethical haha

like

Absolutely it’s unauthorized! Except law students admitted under RULE XX. LIMITED PARTICIPATION OF LAW STUDENTS IN TRIAL WORK . My 3L in a Louisiana I was admitted able to be work actual cases in DA’s office

like

Thanks. Unfortunately they’ve already graduated and passed the bar. Was trying to find the equivalent of that for this liminal space :/

Thank you all! That’s what I thought. Was hoping they’d be admitted by now, but it’s taking forever.

TX board of law examiners will grant a temporary license until results come out. Worth looking into if you want the new hire working in a more official capacity.

Yes - that’s what I was hoping for. OK has it too, but couldn’t find anything for LA.

Im wondering what the hurry is. Are you training them or are you hoping they can cover for any missed objections? I didn’t get to participate in a dep until second year. They can wait. It’s not so urgent.

They cannot even attend the depo. Only counsel and parties are permitted.

Yes, but only at district Court level

Conflicts check question: how much detail will I need to provide to (hopefully) new firm? I’ve been at the same place for a decade…so many transactions over the years! It will be easy enough to gather info by client matter number, but that doesn’t capture sub-entities and/or any other specifics.

I have not been on a project for over 3 months. Since I joined, I have been put in training. The training got extended by a month and now it's close to 4 months since I joined and without a project.

What should I do? People say that I'm lucky to get paid without doing any work, but it is stressing me out. I need the experience. The uncertainty is freaking me out, with rumours of layoffs and the certification program and all.

How do I get into a project? How long do I have to wait more?

As a Creative, do you prefer voice or video for initial project discussions with vendors? How do you feel about follow-up video conferences to go through vendor treatments?

I’ve been working at a rather prestigious midsized firm in a big city for almost a year and a half now. I have been having a lot of trouble picking up work from senior partners. We are required to bill at least 150 hours per month to meet our requirement. My months are typically only 110-130 hours. It seems like the senior partners already have their “go to” associate for things. Does anyone have any suggestions on how i can increase my workload? I reach out for work pretty much weekly.

It may seem obvious, but in my experience partners value trial experience over anything else, so get it however you can. For example, my firm will favor a former prosecutor who has seen the courtroom a lot but has no civil litigation experience (not even a depo) over a seasoned associate who has only second chaired cases with a partner but hasn’t tried a case. Even trying a case and losing gives you credibility at my firm because you still did it.

When drafting a brief or other submissions for court or arbitration, do you use words such as clearly, erroneously, etc. to emphasize certain points? Our managing partner says that we should, but all of the writing guides for litigators that I've read repeats the mantra "show, don't tell" and explain that most judges dread such words.

I know that the politically correct thing to do here is to do whatever the managing partner wants me to do, but I just wanted to ask for other ppl's opinion.
