Realizing that even though I enjoy litigation, I have a really hard time with the amount of hours we work leading up to trial. Four days out from trial and I am exhausted/on the verge of illness from lack of sleep. How do people do this their entire career?

You need to think of right now as the first marathon in a series of ultra marathons. Also, take time off after trial, 2 weeks at least if you can. In the non-trial times, remember how much you don’t actually need to stay up until 1am to get things done, during trial, you do.

I’m not one of those that thinks the legal culture is okay, but the pressure that comes from trial prep is something that can only be mitigated and not avoided.

The only thing I can recommend is as your proceeding through the case, make a sub folder that has notes from everything you have done so you can reflect as your preparing for trial.

If I print out a hard copy and mark it up, I scan and store it in a notes folder.

Preparation is the best mitigator but again, you won’t eliminate it. Also, I second taking time off after trial.

Trials are not for the weak of heart. Truer words were never spoken. Been doing trials almost from Day 1 and I’m now in Year 33. It is physically and mentally exhausting and I second when it’s over you MUST not may take serious R&R or you will experience severe burnout. My wife literally without my even asking once a trial is over will set up and send me on an a flight somewhere (Puerto Rico, London) - anywhere I can turn the phone and e-mail off for at least 3-5 days even if it’s me completely alone. If you’re going to do this work for a living, I highly recommend it for your own physical and mental well-being.

Plus, unless you have multiple trials a year, it is doable. For those who do multiple, month long trials or more a year, I don’t think those people sleep.

All part of the game. Because money is an issue, you put off certain items until the end because you can’t bill for things that may not be needed. Enjoy the lulls during the litigation phase, clear your calendar during trial prep, and take 2 weeks off after trial. Also make sure you plan your internal deadlines so that you don’t have anything due during or right after those 2 weeks.

My temp contract has been extended. I’m relieved to be able to pay the bills, but after giving 70-80 shots a day, I literally dream about giving vaccines almost every night! Struggling to keep positive about finding a new permanent job - I was laid off at the end of April, have applied to over 60 jobs, had 6 interviews, and no offers. I can’t go back to chain retail - it damn near broke me in my 20’s, and it’s much worse now.

I just learned I was parentified severely, especially emotionally. The discovery came from outside of therapy, but having a place every week to sit down, slow down & reflect def led to it. Being enmeshed with my parents like this was a cause for my anxiety, low self esteem and workaholic, people pleasing tendencies. I'm working on extricating myself and finding my identity again in a way that will be easy on my conscience and values..so I'm learning! Please dont hesitate to go to therapy!...

Interesting. Let’s see if the uptick In cases continues to drive an uptick in hospitalizations and then in fatalities. Depends on how many of the cases are incidental or in very young people not prone to severe cases. But either way, look at the hospital capacity utilization figures! This is the untold story. Were we bending the curve to avoid unnecessary deaths due to overcrowded hospitals, or were we bending the curve to buy time for treatments and vaccine, or just to slow fatalities?

I work at a small firm with not that many workable templates so I usually have to do everything from scratch like drafting motions, pleadings, and researching all potential counts every time. Do bigger firms have better and more templates that allow you to have to do less research?

I work in a firm that is known for litigation defense. I’ve been developing my own plaintiffs practice as well. I am able to pay the bills with my hourly defense work, which gives me time to focus on a handful of high value PI case a year on contingency. I was recently negotiating a case and was told part of the reason the claims rep/OC was jerking me around was because they didn’t see me as a plaintiffs attorney. Is there any way to change this perception or does it just come over time?
