Entering my third year of practice. I handle mostly pre-suit but also help with litigation (mediations, depos, CM hearings) and some other matters. Generated about $1.2M in fees this year so far (up from ~$760k). Currently make $105k + 5% on banked fees over $800k. For 2026, is $130k base fair for this level of production/role? Also trying to figure out firm percentage fee and what to adjust. Any thoughts appreciated.

Depends where you are - NY, LA, somewhere else - but if you are bringing that in for the firm that’s a respectable increase. My fee used to go up once I crossed a threshold. Maybe worth negotiating 5% on anything before $800k then 7-8% on anything over.

I would put more effort into bumping that percentage up to 33 1/3%.

Definitely fair. Unfortunately, you may have difficulty getting the firm to bump you 25K in one year (despite a 500K revenue increase)

In an auto accident trial, can you inform the jury in any way that the at-fault driver had insurance? I have a hard time believing a jury would award 7-figure damages if they thought the little old lady defendant had to personally pay. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting. What’s a good LA or NY business litigation firm and salary to expect? I’m a 2yr with quite frankly a lot of experience across civ rights, PI, excessive force, wrongful death, employment defense, K dispute, corp. structure dispute, professional licensure. Does anyone remember their first trial? How did you feel and how did it turn out by comparison? Anything you wish you did differently?
