Hi Ladies, I’m desperate for some advice! My husband is finishing residency this year and he found a job on the west coast (we’re currently in Chicago) so we’ll be moving in September. An added complication is that I’m pregnant and expecting to give birth late July. My firm has a requirement that you return to the office for at least 3 months post maternity leave. If I don’t, I have to pay them back. (Continued in comments).

It sounds like your firm doesn’t have an office where you’re moving, and won’t let you work remote? Assuming that’s all true, I’d probably start looking for a new job right now, it’s possible that a firm really needs your skills and is willing to let you start, take leave and then come back (although unlikely). If you can’t find something new, I’d stick with your firm and pay back the mat leave as necessary. They shouldn’t make you pay back STB leave, and you’ll keep healthcare, which will be cheaper than COBRA.

Agree. Also, is no one else of the mindset that they ‘dare’ the firm to litigate this employment contract to try to recover paid maternity leave benefits? Maybe that’s just my risk tolerance, and could be bad advice for some. Depends on whether you want this bridge. Ask for remote flexibility in the last month of mat leave. If they don’t agree, send a notice of resignation on the day you are scheduled back (effective 3 months after your mat leave return)…maybe they’ll fire you and covenant doesn’t apply. Volunteer for work, but don’t go in office. Their game is old and silly…make them work for it.

Would you recommend that (i) I just quit in June and get COBRA, (ii) take the maternity leave and quit once we’ve moved (and pay them back) or (iii) something else? Thanks!

And I know this isn't unique to your firm, but how TF is it legal to require you to payback maternity leave? Do forms do this for other leaves such as bereavement and non-pregnancy disability?

like

Yeah they pay insurance so you get paid mat leave but then if you don’t make up the 12 weeks you were home with a helpless newborn, they are permitted to ask that you pay back that leave because heaven forbid as a working mother the state or the corporation you work for accommodate you.

Thanks everyone for the responses! I’m so glad the women in law bowl is filled with so many supportive individuals 😊

Will find out more from the leave department to determine how the payback requirement works. Frustrating that so many firms market themselves as pro-women and understanding but we still have to deal with this…

Is there any chance you could lateral to another firm in Chicago with the expectation of transferring to the CA office when you return from leave?

So sorry you are in a rough spot like this.

Whatever you do, don’t assume that you have to take COBRA in order to bridge a gap in coverage. Start now at looking into private plans that meet your needs, especially since you’re moving and will presumably have to select new providers anyway.

I made the COBRA mistake when I got laid off just months after my husband’s serious medical crisis. 90 days and $10,000 later, I finally selected a new private/ACA plan with the same insurer and nearly the same coverage/deductibles etc. as my former job. Cost for my family of 6 was $800/month instead of $3000.

It was insanely expensive, I will say. I hated paying it. But I an grateful to my dr after the first pregnancy/birth was crazy traumatic. In that regard, it was worth it. It’s all a shitshow.

Do you just have to pay back your health insurance costs, or the entire cost of parental leave? The first would be normal, the second would be very abnormal. I suspect that the firm will waive the repayment if they won't let you stay because you have to move. I can't imagine that it financially makes sense to skip out on paid leave over the cost of medical coverage.

Only us jaded girls in the US would think any of this is normal. Take this to any girl all over the entire world and they would laugh in our face about what goes on here.
