Sounds like a pretty strong pregnancy/disability discrimination and FMLA retaliation case
Do you have this in writing……
I would talk to an employment law attorney
Haven’t been in that position, but for a law firm, that seems incredibly irresponsible as they would be violating the pregnancy discrimination act (PDA) and pregnant workers fairness act (PWFA) and FMLA. Definitely document everything they’re telling you on this, make sure all your requests are in writing ajd that you reference the appropriate statutes (and you can even get a doctors note) and document their responses are in writing. It’s probably better not to resign, but you could file an EEOC charge or find an employment lawyer to speak to since they already made retaliatory statements. Just don’t threaten legal action.
The lawsuit of my dreamzzz
Unbelievably, I do have it in writing. I am talking to an employment lawyer, I think I’m just more concerned with the job hunt aspect. The writing is on the wall there no matter what I do - I don’t anticipate being there much longer (involuntarily or otherwise). I’m worried about finding a new position and then immediately needing time off, and I can’t imagine applying for jobs now and asking for a very delayed start date (if I even find one).
Have you tried looking at "The Mom Project" for work?
My obgyn was hesitant to sign any notes for accommodation (i.e., wft) stating they could be unreasonable and I could he then fired. I asked about the possibility of a note the month before my due date given I was moving. (Luckily my boss didnt care where I worked despite the company policy so I didnt need a note).
Contact an employment litigation attorney. You are protected from this type of treatment.
Also you have a perfect reason to leave. Any future employer will understand you took off due to the reasons related to pregnancy.
So sorry 😌 that is just awful behavior.
Just found this post and would love an update. How did everything turn out? Did you end up looking for a new job??
