Is anyone else here engaged and wondering whether or not to hold off due to the current administration? I am working on drafting my pre-nup (I am an attorney and make a lot more than my fiancé and have higher earning potential) and I don’t know if I’m being paranoid about its validity if my access to and control of my finances could change in the future as a result of some whacky project 2025 nonsense. I almost feel like I want to hold off getting married… any thoughts?

I cannot imagine a world where that is true. Regardless, I think it’s hard to predict whether it would be better to be married or not in that environment. If you’re nervous, I would probably stick some money in a separate account for a rainy day that you don’t share with anyone. And you’re getting a prenup, that’s good. And probably talk to your husband a lot about your plans for the future, expectations, his politics. In this climate, I do feel like it’s really important to vet your spouse. I cannot imagine marrying someone who ended up being closet MAGA or had certain unspoken expectations about what life after marriage would look like.

But, no, if you’re in love, and you want to be married, be married. Don’t let some idiotic orange bully stand in your way.

Oh, but definitely don’t change your name. I think that’s a non-starter these days.

You are worried about nothing. A prenup is a contract and it is enforcable through a court of law. It’s awkward to have to explain this to another lawyer. But here we are, I guess.

As a woman, don’t marry someone who makes and you foresee continuing to make less than you. If you do, live based on his income and set aside a good portion of your assets in a secure way so basically even you no longer own them. I’m perfectly ok with the whatabouts coming for me with anecdata. I used to think marrying within one’s “class” was antiquated and backwards. I’ve lived enough and seen enough to understand it. Our continuing patriarchy makes it hard for that kind of relationship to last.

If you and your partner love each other and want to have certain legal rights like power of attorney or survivorship, but you are worried about your assets, you can consider contracting around it and not marrying (e.g., living wills and beneficiary designations.

Marriage is the worst case of the mingling of church and state I’ve ever seen and, the way things are going, we are going to see more and more church.

If we’ve tossed out the rule of law to the point where women and their assets belong to the men in our lives, we’ve already lost as a society. That said, if we’re at that point then you likely belong to your husband or your father, so keep that in mind with respect to who would work with you to get you what you want.
If you have doubts that your husband would actually take care of you, and defend you and your right to self-determination, for me that would be an absolute red flag about getting married. My husband is not my best friend, but he is 💯 my partner in life, and thinks it is utterly ridiculous that anyone would give him control over what is clearly my decision.
Also, strongly agree that in this administration, we don’t change our names. I’ve been married for 12 years and have never regretted not changing my name.
