Is there a conflict of interest if I represent a injured person who is an employee of an insurance company in that person's hybrid personal injury/ and workers compensation case, if I also have separate personal injury cases against defendants insured by said insurance company? The potential client is not directly handling any of the cases I have against that insurance company. Thank you

For clarity, can we apply some names to this hypo? You represent an employee of Progressive. The liability carrier for that client’s BI claim is Progressive. You have another client with a claim against Progressive. Is that the scenario you’re wondering is a conflict? Is your client the assigned liability adjuster on a claim you’re representing?

Essentially yes, but client is not involved in any of the subject pi claims.

Sounds like “no” - the question is really if the clients are adverse to one another and it doesn’t sound like it here. Of course you need to look at local rules, etc. I serve as outside General Counsel to small law firms, shoot me a DM if you want to chat more.

4th year at a mid size PI firm. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting. I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

How much support staff is reasonable to expect? Plaintiff PI, med mal/aviation and we’ve lost 2/4 “paralegals” in the last month. Lack of support staff really beginning to feel like it will limit my ability to handle the usual caseload. Was on an island before, and only going to get worse…

What’s a good LA or NY business litigation firm and salary to expect? I’m a 2yr with quite frankly a lot of experience across civ rights, PI, excessive force, wrongful death, employment defense, K dispute, corp. structure dispute, professional licensure. Write every kind of brief, appeals, argue motions, take depos. Am the only associate working directly under partner on all cases. I’m currently discontent with my income.
(3rd year. Salary=80k and no performance incentive. I brought in $1.4mm AFTER partners claimed over half of fees on my big cases.)
I see CJL offers an incentive+ base but I’m curious about that structure.
Any good or bad firm culture to speak of?
Is it impossible to actually earn a respectable incentive bonus?
Am I going to have some partner come cut me out of any cases where I might actually make a solid fee?
