I've always been told they are only obligated to pay the two days. And I can confirm a company let me go the day I put my two weeks in and they didn't pay me anything for the two weeks I gave them. Legally, I don't think they have to pay you if you don't work.
It depends on the state you are in. Where you may not be obligated to pay the two weeks in some states failure to pay the notice period equates to turning the resignation into an involuntary term and the employee could be due unemployment.
Happened to me when I came in to manage an Agency of 150 employees. Company would let ppl go the day they gave their notice and not pay them for the 2 weeks. Employee’s got wise, and gave NO NOTICE. Employer was upset that ppl would do this to them!! I changed things back to paying them for the 2weeks…I left 6 months later …
Obligated to pay the days worked. However, I agree with the above (paying out the two weeks). It’s not legally required, but it’s the right thing to do.
