This was a fraud/theft case. Defendant had bad facts and only strategy was to stall/confuse at every turn. Inching closer to the finish line. Defendant starts firing attorneys and bringing in attorneys crazier than the last. She refuses to show up for deposition. We obtain a court order compelling her deposition. She shows up with crazy (I think he was on steroids) OC. Gets flustered at some point, stands up and leaves the room in the middle of the deposition. We have to go back to the court to compel again. OC insists that we acted badly during the depo and we need a discovery referee present if there is another depo. Fast forward to continued deposition with retired judge, court appointed discovery referee in the room physically. OC instructs her not to answer. Discovery referee tells him that his objection is invalid and she must answer. OC looks at discovery referee and tells him that he isn’t the judge and he doesn’t care what the ruling is, his client isn’t talking. We end up back in court to compel answers to those questions. The judge is admonishing OC. This is in open court, before covid, full calendar, tons of attorneys in the audience. OC gets so angry that he stands up and is just seething staring at the judge. She tells him to sit down. He doesn’t sit. She tells him that if he does not sit, the bailiff will help him find a seat. He waits a solid 3-5 seconds before finally sitting. Everyone in the room was whispering and in complete dis belief. The guy was absolutely insane.

I’ve come to encounter tons of attorneys like him since then. Thieves and con men are bound to retain the scummiest attorneys.

I’ve heard of a special referee to monitor a deposition just never seen anyone have to follow thru. At a prior job I appeared on a deposition and my client sounds like witness here. I took him out of the room screamed at him didn’t matter. Recommended to firm we withdraw as counsel they refuse. I refused to appear on anything for this case. Next associate same thing. Ultimately withdrew when he threatened our trial attorney. I believe the exact phrase was I’ll west your ass as a hat.

Never heard of having a discovery referee in a deposition. I’ve had attorneys call the judge in the middle of a deposition to rule on objections. It’s ridiculous and really all for show.

I received a job offer from a PI firm (MVA and tractor trailer cases) in Houston, Texas; the bonus proposed was 2.5% of attorney’s fees for any cases settled each quarter. 4th year at a mid size PI firm. Got pulled from litigating MVAs to help this solo we hired start a med Mal/nursing home practice. 1 year in and it looks like I’m two steps backwards in terms of getting paid because we’re a year or more out from a lot of the fees hitting.
