For anyone who practices tax lit in the US Tax Court, what’s your experience with the independent office of appeals? They don’t seem quite that “independent” to me and so far, I’ve only had one appeals officer who seemed knowledgeable and nice. It’s been a real headache. Interested to hear other people’s experience.

They are independent. But they don’t always do their homework in advance of the Appeals conference. Agree with A1 that it depends on which AO you’re assigned

Very interesting. At this point, it might make sense to wait for Chief Counsel and have another bite at the apple. You could always complain to the Appeals Team Manager once you’re out of the Appeals woods (or perhaps before too).

Hang in there. There are some really good appeals officers. You’ll come across bad apples, of course, like anywhere. But if you ever have a case where they are clearly not acting independently, you can request a call with their manager. I have had an appeals officer switched out where, before even reviewing my appeal, he said my argument was “stupid.” I went on to get a great result with another AO.

When renting a condo from an owner, I was asked to pay a $150 move-in fee to the building which I thought makes sense, but then I am being told to also pay a $500 non refundable move in fee to the owner but he is not wanting a security deposit. Is this normal? Seems like $500 down the drain but not sure if this is normal

When the IRS (e.g., a RO/AO/Examiner) calls or writes a letter… How do you verify that it’s really the IRS and not a scam? I’m new to tax law and I’m worried that I’m going to respond to/answer a scam and give away client info (or my own tax preparer info). I have a tax LLM and started my career out of law school doing M&A tax at a big4. After 9 months, I got out of big4 transactional hell and into whatever litigation I could find. Has anyone dealt with stuffing allocation in a non-hedge fund context? It seems even in the HF world the law is fuzzy in using aggregate reverse 704c principles in stuffing allocations. Like, sure, the market is there but no authority really blessed it (other than some Cravath partner’s article in Tax Notes in 2013). If we are talking asset class that isn’t really like marketable securities but might be able to treat it similarly solely by virtue of, say, valuation on a quarterly basis (contd)
