Sometimes, but if you have similar cases, you can just use your own work as a template
Can’t you just use Pacer (or state court equivalents) to find precedent filings? I’ll often do a quick Westlaw search to identify some cases in the right area of law, then go on Pacer (or equivalent) to pull the filings the parties made in the most similar cases and/or before the same judges.
Bloomberg Law is fantastic for precedent.
My firm has a huge case management system where you can search the entire firm for a previously drafted document. At my last firm there was a very inadequate document bank so I ended up making my own and saving documents anytime I came across something new.
Yes. Not only do we have our own templates, we also have access to other counsels’ precedents from the thousands of other cases we litigated.
Yes. I was previously at a smaller, mid-law firm (200 attorneys) and I preferred their templates because I at least knew (or knew of) the attorneys who drafted them and knew which templates not to rely on. At my new firm (1,000 plus attorneys), I have no idea who anyone is and for all I know, they could be an idiot 😂
Yes - I’m in biglaw and we have templates for every mtn under the sun. The key is locating it on our CMS. I can’t imagine having to draft everything from scratch. At least you get in those billables
Hahaha yes true but I’m just over it😅😩
Yes. All the firm's work product is saved and accessible through our CMS.
Yes absolutely!
