You can always sue someone regardless of whether you’re in the right or wrong. Why do you think I carry malpractice?
Tbh if HR ignores them I'd let it go. Not worth. Now if your company takes action against you for an unsolicited claim without proof then I'd sue your company. Think bigger, not bitter.
I don’t disagree that anyone can sue anyone at any time, but the actual answer is that a person can bring suit against someone should they so desire AND have a articulable claim. As described, you have a false accusation of recording, I presume contrary to company policy, taken to HR. To have a case against the person lying, you must show they lied and this caused you to suffer an injury and the court can remedy your injury. So far you have no injury (e.g., loss of income). Other than is a few jurisdictions, you likely have no cause against your employer if they do fire you unless you are a member of a union, there is a policy a court can enforce and that you can show your employer failed to follow, or you can show you are a member of a protected class and your firing was discriminatory. Plus, it is unlikely anyone will take on a case where the client is unemployed and may have no way to pay the attorney. Sorry to discount, but I see no case.
Usually, anyone can sue anyone. However, you need to talk to an attorney to understand specifics of your situation and if a settlement is even likely. Go talk to an attorney if it's a serious matter.
If you have real damages like losing your job, yes. Otherwise, no.
You'd have to prove they knew you weren't recording and show damages. It's an extremely difficult case.
Texas is a 1 party consent. You would likely lose even if you started the case and somehow didn’t get out on admin leave with HR on their watchlist. Just state your case, maybe file an internal report of your own.
You have to record yourself NOT recording them in order to get away from this scot free. 24 hour surveillance of yourself at your desk.
