I recently left a company that said they could no longer pay me and asked if I would work for free. Essentially the same thing you’re describing. Turns out I was not the first person they had asked to do that. We all said no. And no, it is not common, at least not as far as I know.
No, it is not common, and you are owed the wages. They need to pay you.
Can’t pay so they let you go and advise you to file for unemployment? They need to pay for hours worked, and if they can’t continue to pay you then they need to let you go and you’re free to file for unemployment.
Pretty sure all of this is illegal. They legally owe you compensation for hours worked. And it’s fraud to get paid unemployment while still working for them.
Speak to an employment lawyer in your state. And find a new job asap.
thats exactly where I was going with this too.. This is WILDLY illegal they are asking you to defraud a state government program. If caught you face possible jail/prison time, fines, ineligibility for future unemployment earnings and of course paying back what you were paid. Also you could forfeit your right to future income tax refunds. Not to mention they owe you wages for hours worked! I would report this company and find another job. good luck!
I talked to a guy this week who is trying to get people to work for shares of the company in lieu of a salary. He believes he will get it launched mid-October. When we were going over things, the software was glitchy. He has been working on this project for 10 years and mentioned he fired a few people. I believe in being open to possibilities. However, at the end of the day, I did not want to waste valuable time. If they are asking you to file unemployment and continue working for them, my advice is caveat emptor.
