I am in the middle of doing this now. First time I have ever had to do it. (I came close in another case about a year ago with a super rude client, but I was able to get them to behave somewhat better after a serious conversation. Plus, I hung on because the case was good.).
On this one, it’s a perfect storm. Client won’t listen to advice, won’t let me try to negotiate a settlement in a range that I believe is appropriate, won’t timely provide information that I need to respond to discovery, and does not want to understand or accept my analysis of the case. (major problems with the case have come to light)
There is no saving the relationship. Client would not agree to substitute me out, so I am filing a motion to withdraw. It sucks. Time, wasted, fees waived, costs waived. It is going to take months to extract myself from this.
Curious how you were able to bring the previous super rude client around (how did you prepare for and conduct the serious conversation)? I need help getting the courage to have those tough conversations while maintaining my poise. The risk of the other person going off and slandering me in retaliation is a concern.
The in house counsel was micro managing the case and I disagreed with the course action they wanted me to take for the amount they wanted to pay for it. It didn’t involve illegality or anything like that but I felt strongly enough that I declined the representation.
For years I beat myself up wondering how I could have handled it differently for a better outcome but in the end I’m glad it happened the way it did. I’m much better off now than I was with that client.
Yes. Lied to me several times and did not pay bills. Easy decision.
