Do you retain an engineer on every trip and fall case in order to establish a code violation, etc? If so, at what stage of the litigation do you retain an engineer?
Some of my cases are lower value so I’m not sure if it’s worth it to retain an expert. I have photographs that clearly show a sidewalk defect/code violation that an engineer could potentially use if the case doesn’t resolve and defendant subsequently repairs the defect.

100% not necessary in my jurisdiction. We only retain engineers on difficult liability cases, and when a defect isn’t obvious or there’s a design flaw. In my state there’s a lot of case law with trip and falls so a photo and a measurement is usually enough to argue liability on a dispositive motion without an expert and establish liability at trial

I’m currently discontent with my income.
(3rd year. Salary=80k and no performance incentive. I brought in $1.4mm AFTER partners claimed over half of fees on my big cases.)
I see CJL offers an incentive+ base but I’m curious about that structure.

Is it impossible to actually earn a respectable incentive bonus?
Am I going to have some partner come cut me out of any cases where I might actually make a solid fee?

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

Has anyone ever dealt with Geico UM case where they insist that a release needs to be signed? Geico extended our client’s policy limits but wants him to sign a release. We offered to sign an acknowledgment of receipt of funds but Geico said without a release signed, they will not issue payment.
