The law is ephemeral and arbitrary at its core and at its margins. If you get deep enough into jurisprudence or far out enough into the new frontiers of law, you realize it’s just a collection of people (given various levels of authority) writing down what they think about things; well enough of course, that others are willing to accept and repeat it.
You are likely fine. The murk and incongruities we experience are part and parcel of the job, and arguably the reason why the profession exists at all.
I think I’ve struggled with this since law school. Thank you for the reminder. It’s easy to get caught up in the business wanting a single answer sometimes.
Just keep learning and growing, stick to core principles as A1 said (if I had a dollar for every time I said “minimum necessary for a particular purpose” or “role-based access controls” I could retire today), and keep in mind that everyone…EVERYONE…is just making it up as they go. You’ve got this.
I think everyone in the US feels that way. And with more states now beginning to look into and enact their own laws, I fear it’s only going to get worse.
Been doing privacy work for many years and still get imposter syndrome now and again. Let it motivate you to do more research, talk to more peers, and improve your skills.

Of course you are capable. Core data principles and concepts should always anchor your advice (transparency, proportionality, minimisation, etc). Build on those step by step, look for advice from your peers and seniors (a mentor if you are really lucky) and be patient with yourself. The situation in the US is especially complex but the market for dp lawyers is going to be all the more intense for that reason. Good luck with it!
