I just found out that my bonus for last year is prorated for the time I spent on maternity leave, which was NOT told to me and definitely not part of the firms policy (which is incredibly vague for the record). Do any other firms do this? For context my 2000 target was reduced for the 16 weeks I was on leave, and I well exceeded that target.

My firm prorates based on leave, but there is a true up for each hour over expected hours. The year I took my leave, I think I worked 14 hours more than my target and those were factored into my bonus.

I don’t think we do that with leaves but I know at my firm if you were only there part of the year or if you are on a reduced FTE your bonus is prorated

My firm prorates for all types of leaves. It’s written into our bonus policy though.

Depends on the state, but you could argue that this is discrimination for your parent status. Harder to argue if all leaves of any type are prorated this way.

My firm does. It sucks, but I think it’s standard for biglaw.

My firm prorates for leaves.

My firm (big 4 L&E) sort of prorates it. We have different bonus targets, so your leave doesn’t count against you for the basic bonus but it does for the others. So ex our min hours requirement is 1900 hours. If I got 100 hours of leave credit, then as long as I hit 1800, I still get my first tier bonus (because I’ll hit 1900) but if I hit 1900, then the 100 leave credit hours do NOT count for the next tier bonuses (which start at 2000 hours). It’s really difficult to get the second tier bonus if you are on any maternity leave, which really sucks. I’ve hit the second tier bonuses the last two years (even including last year when I was on maternity for part of the year) and I know I won’t get it this year.

I exceeded my prorated hours by about 30 hours and also got a prorated, and incredibly low bonus (worth less than a week of pay!)

Update: HK does not prorate up based on the hours you work. So even though I billed well in excess of the target based on FTE with mat leave, I don’t get the benefit of those hours. Why did I ever feel guilty about being on leave and agreeing to work some…sigh
