The first layer of insurance reps are the least experienced. They throw numbers out having
No clue what is fair. Usually put it in the computer and they spit out a number to try and make you bite. They won’t get serious until you file suit or get close to trial. That’s the game they play. I was an adjustor and have practiced 30 years playing the game that insurance companies play. Most are afraid to try cases as the environment is plaintiff favorable.
I’ve asked to mediation since we’re not getting anywhere. May need to file suit though I’d much prefer to avoid that (attorney’s cut obviously goes way up if suit is filed)
If you are still having numbness, I would be seeking additional orthopedic treatment and if the adjuster is only offering $10k, I am filing suit and moving the case forward. While I am not licensed in CA, I worked with attorneys who were licensed in CA and they often used 998 Demands. This tended to assist significantly in increasing settlement offers at least from my experience in working with them.
Like getting an orthopedic consultation and getting recommendations like do you need injections ESIs or do you need surgery as PT and Chiro havent done much for you
Did you have any surgery or injections what state and county are you in. Did you miss anytime from work. What are the policy limits
letter that was previously sent, but I'm not sure my lawyer will send me my file and don't want to unnecessarily piss them off (am in CA so believe I'm entitled to a copy of my file). I guess I'm getting frustrated because it's been a year and a half and don't feel like this is going anywhere despite still feeling pain/numbness from the accident
As a plaintiff’s side PI lawyer in CA, I think $10k is $10k more than most people would offer you. Unless the pedestrian was a close relative, you have no claim for damages for witnessing that, and I don’t think the collision caused any of your injuries, unless it hit a pole or some other fixed object after. The delta-V in an auto v ped accident is basically zero so l think all your injuries are pre-existing, and $10k is generous.
i don’t understand ur response, particularly the “pre-existing” injuries. do u not take the plaintiff as you find them - eggshell skull?
