If you were hired as part-time and you got over 32 hours one or two times out of out of the year and you still can be part-time but if you're doing consistently 38 to 40 hours a week consistently then you are considered full-time so what they're trying to do is not legal
I agree. I would fight this if I was OP.
Most of the time you can submit paperwork through your HR to get your status switched from PT to FT, if you’re consistently working the hours to qualify for FT they should definitely switch it

You must average 32 hrs/wk or more in whatever given timeframe (usually 1 year) to be considered full time. However, if you started say, 6 months ago and your weekly average is 32 hrs or more, you are full time. As far as a raise, unless anything was put in writing, you aren’t entitled to one. On the other hand, if benefits are offered to full time employees only, you would be eligible.
This. A raise has nothing to do with PT or FT. So them saying that is BS. But you are not “entitled” to a raise (I use quotes because IMO we should all get at least yearly raises), so they can deny that - what they can’t deny is benefits if you meet the federal requirements.
