There is zero constitutional law in question.
The only question even tangentially related to the constitution is "Did Trump's lawyers bother to read it before filing this crap?"
I'm sure no matter how the court ultimately rules, Roberts will find a way to drag out releasing the court's decision until mid-November.

If I was a betting man, I would bet that this was what William Barr promised Trump, and what he's been after his whole career.
You can go check Barr's record. He freely speaks of Presidential immunity.
This attempt to accomplish this is probably an attempt gauged for failure since what he's really after is a precedent ruling, meaning it will define the surface where the first potential rock climbing anchor can go. Additionally, I don't think he's putting this together because he can win it at this time, but to create the narrative that Trump's supporters will gladly support over time. This is a long play made to make the office of the presidency as immune as possible, because, in Barr's mind, this is a Christian nation and the President is the culmination of the Christian direction. Not my words, but Barr's. It's a play to harden the tip of the spear and the current political environment has shown that there are people out there stupid enough to support it and media greedy enough to regurgitate it.
Trump, to Barr, is the vehicle to obtain this goal. He could care less who's in the office. He was waiting for the conditions to be right.

Certainly presidential immunity is a slippery slope that will just further split the parties. Maybe this is where Biden should just fall on his sword. Get accused of something and go to court to set the precedent that the president answers to the people, and more than just on Election Day.

His attorneys had been arguing this in court and were overruled. So now their appeal is to go right back to it, and with Willy B at the helm, I’m sure he’ll roll over and make it happen. And so by the time the 2024 elections come around, Trump Jr will be elected POTUS essentially guaranteeing that the Trump dynasty stays in power forever. And all the Trump minions will sing praise to baby Trump Jesus and make holidays and statues in his name. lol.
