What is a typical fee structure for moderate value pi cases? I hear most firms are 1/3 then go to 40% after filing. Is that the most common? Are there other variations? We are think about changing ours but would love to hear what others are doing

Probably depends on the max amount your state bar allows.

I have heard upto 45-50 at trial, but that seems high to me on more straight forward cases

State bar generally has a form contingency fee structure

Generally whatever the bar allows you to charge unless you’re in a specialized area (med mal as an example)

I have my firm set up as 1/3 pre lit, 40% upon filing, and 45% when experts get designated.

I’ve heard of a firm or two having their fee structure be time based, e.g. 1/3 under 6 months, 40% at 6 months and 50% upon filing; this seems a bit shady and grimy to me bc how many PI cases from inception to settlement finish in under 6 months? Treatment alone usually take at least like 3-4 months, add in 30 days for a demand letter to be reviewed and answered, etc.

Ya that's also shitty because it gives the firm incentive to screw around and drag it out

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

What's your preference for plaintiff's side? Steady pay at approximately $120k with no bonuses, or a base salary of $70k plus a cut of what you close over a minimum threashold? Midwest-ish market. In both situations, you get a cut of what you bring in.

Has anyone ever dealt with Geico UM case where they insist that a release needs to be signed? Geico extended our client’s policy limits but wants him to sign a release. We offered to sign an acknowledgment of receipt of funds but Geico said without a release signed, they will not issue payment.

I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I give my cell phone to all clients routinely. However, there are always 1 to 2 clients who abuse this and it seems as soon as their cases are over I find a new one and it is making me rethink. I hate to do this because 98% do not abuse it and I like being connected to my people. Thoughts??
