When y’all have bench trials, what are typical awards?

Here in my jx, in little league/entry level court, it’s pretty typical judges award 2x the medical bills.

That sounds like a fair jurisdiction. I’ve seen better and I’ve seen worse and that’s in the mid range.

My experience (only comparative fault jurisdictions) in bench trials is judges are more likely to hold with bright line rules (all rear enders are the Def’s fault) (all left turn failure to yields are the turners fault) because it keeps their life simpler.

For those also going through this, any tips on how you manage yourself day to day? What self talk tends to help?

I am a personal injury defense attorney and I’ve never done plaintiff’s work. I have a case where I suspect the plaintiff is malingering and exaggerating his injuries. The plaintiffs attorney has sent me multiple demands for $3 million dollars and basically begged me to respond with some offer. I’ve told him the truth - my client has no interest in trying to settle if his demand remains about twenty times higher than the actual worst case (for us) jury verdict. More in comments...

Hello All,
I am finishing up my second year of practice as a lawyer. I transitioned to plaintiffs pi work from a boutique commercial litigation firm. I like the work and not having to bill. The issue I am having is managing volume. I have about 150 active files some pre-lit and the rest are in litigation. Cases range in value from very small to low six figures. I also take the driver seat for the grunt work on the firms bigger cases which are at or near 7 figure value. I constantly feel (cont.)

Plaintiffs PI attorneys, how many cases on average are you assigned to at any given time?

I currently work at a small PI firm in Atlanta were EVERYTHING is settled presuit. If we’re unable to settle, then it’s referred to another firm for litigation. This whole process seems very atypical to me and the attorneys rarely touch a file until the first liability offer is received. The paralegals handle everything from intake to drafting the demands. The attorney briefly skims (does NOT read) the demand packages and signs. Is this ethical?? Anyone else work at a firm that is run this way??

Bad faith lawyers out there- do you have success getting extracontractuals with blown policies that were achieved via technicalities or borderline deceptive set-ups? I’ve done PI work my entire career for over 10 years. I’ve worked in state and federal courts and I’ve traveled around the country doing MDL work and bellwether trials. I’ve had a lot of success making the idiots I’ve worked for wealthy, but I’m still waiting for a moment where I enjoy what I’m doing. I feel stuck working in dysfunctional plaintiff firms/cultures. I hate this profession/career more and more each year. Has anybody been successful breaking off on their own in recent years? Advice?

Does anyone like ID work? Currently doing work at a PI/Medmal plaintiffs firm while in school and trying to figure out where I’ll be happiest post-grad. I received a job offer from a PI firm (MVA and tractor trailer cases) in Houston, Texas; the bonus proposed was 2.5% of attorney’s fees for any cases settled each quarter. We are assigned 50 cases a quarter and the top attorney clears $25K each quarter. This is my first time working at a PI firm. Can anyone share any guidance? Is 2.5% industry standard? Is it realistic to settle/resolve that many cases? I am trying to learn more about this niche before I counter-offer and attempt to negotiate.
